Expertise

Maurits Barendrecht (1956) practiced law at a major Dutch law firm (1982-1997) and is professor of Private Law at Tilburg University since 1992. He studies dispute systems (legal procedures, negotiation processes, ADR, informal dispute mechanisms) from an interdisciplinary perspective. He systematically looks for knowledge from economics, psychology, organisation theory, negotiation theory, and conflict studies that may be integrated with best practices, in order to improve dispute systems so that they serve the interests of the people that rely on them in a better way. An important - but little studied - element of dispute systems are objective criteria: simple rules of thumb that can be used to solve distributive issues.

His research is often done in cooperation with stakeholders such as client groups, ministries of justice, the judiciary, or those involved in the supply of legal services. This approach more or less naturally leads to participation in innovation processes in the realm of justice and governance (interactive projects with stakeholders, negotiated rulemaking, Online Dispute Resolution, Microjustice). Currently, his focus is on access to justice (measuring and assesment, reform of legal aid, access to justice for the poor in developing countries), see www.measuringaccesstojustice.com and www.microjustice.org. The broader assumption he starts from is that innovative legal systems can contribute to improved and more productive relationships, which are primary carriers of economic and personal growth.
